CKT UTAS, SRC President, aspirant lock horns in court over SRC elections

The C.K Tedem University of Technology and Applied Sciences (CKT-UTAS) has been sued at the high court in Bolgatanga by one of its undergraduate students over the Students Representative Council’s ( SRC ) election results tussle.

The suit has the CkT UTAS as the first respondent, Mohammed Bilal, who is the chairperson of the SRC Electoral Commission, as the second respondent, Awana A. Michael, the SRC president-elect, as the third respondent, and Abdul Warris Alhassan, who is the interim chairperson of the SRC Committee, as the fourth respondent.

The plaintiff, Alfred Asante, a 4th-year student and an SRC presidential candidate in the said elections is praying the court to among other things declare that the election conducted on 17th February 2022 that resulted in the third respondent emerging winner, null and void.

According to the plaintiff, the elections were marred with irregularities skewed to the benefit of the third respondent.

In his statement of claim sighted by A1 News, the plaintiff claimed that he petitioned the first respondent with evidence to investigate the allegations.

The first respondent called all the presidential candidates involved in the election together with the second respondent to deliberate on the concerns raised. The tripartite team agreed to hold on with the declaration of the results by the second respondent while a Committee was set to look into the allegations.

The first respondent through the Dean of Students Affairs set up a Committee to look into the merit of the claims.

According to Asante Alfred, the Committee concluded its investigation within the stipulated time but the report was not released to the students, meanwhile, the second respondent went ahead to officially declare the results.

The plaintiff is therefore seeking six reliefs from the high court, Bolgatanga

“A declaration that the election conducted on 17th February 2022 which resulted in the election of the third defendant as SRC president of CK Tedem University of Technology and Applied Sciences has been seriously marred by irregularities and therefore null and void. A declaration that any purported swearing-in of the third defendant as SRC president as is being programmed by defendants to take place on Thursday 21st April 2022 is violated by a flawed electoral process and thus equally null and void. A declaration that the recommendation contained in the report of the Committee set up by the first defendant is implemented by conducting fresh elections for SRC. An order directed at the defendant especially the second defendant to conduct fresh elections. An order directed at the first defendant to as a matter of urgency release the report of the Committee set up to probe into irregularities that ensued during the conduct of the 17th February 2022 SRC elections. Any other order that the honourable court may deem just and proper.”

The case which was heard today 10th May 2022 has been adjourned to Tuesday 17th May, 2022 because the first respondent’s lawyer pleaded with the court for more time to file his defence and the court upheld his plea.
