It will be difficult to prosecute Carlos Ahenkorah-Lawyer Ndebugre

Private legal practitioner, John Ndebugre says, former Deputy Trade Minister Carlos Ahenkorah cannot be prosecuted for visiting a voter registration centre despite his COVID-19 positive status.

Notwithstanding his resignation from office as a minister, there have been numerous calls on government to press criminal charges against Mr. Carlos Ahenkorah for breach of COVID-19 safety protocols after testing positive and been directed to self-isolate.

But Speaking on A1radio Day Break Upper program, lawyer Ndebugre said, government will have no locus to prosecute Carlos Ahenkorah since his offence and corresponding sentence is not contained in the new Executive Instrument (E.I 164) gazetted in June, 2020.

Mr. Ndebugre argued that, the law only criminalized the refusal to wear nose mask for which one could be fined GHC12,000 to GHC60,000 or in default serve a prison sentence of four to ten years or both.

“I don’t know what Carlos Ahenkorah should be prosecuted for?. The Executive Instrument (E.I 164) was specific about the wearing of nose mask and face shields but the Carlos Ahenkorah said he went out alright but was wearing a mask.

I don’t know any of the E.I 164 that if you are asked to self-quarantine or isolate and you move out you have contravened the law, I’m not sure of that”.  

Mr. Ndebugre challenged persons calling for the prosecution of Carlos Ahenkorah to make a formal complaint to the police for investigations and possibly prosecute if their allegations are rooted in law.

“Has anybody made a substantive complaint against Carlos Ahenkorah? . Somebody should go to the police station to make a report that, Carlos Ahenkorah was tested positive of COVID-19 and yet he  intentionally  came into contact with him or her and after he or she have mentioned that, Carlos Ahenkorah may have transferred the virus on them and then the process can start”.

Calls for Ahenkorah prosecution

Many Ghanaians have commended the former Deputy Trade Minister Carlos Ahenkorah’s decision to resign from post but demand his prosecution to serve as deterrent to government officials.

General Secretary of the opposition National Democratic Congress, Johnson Aseidu Nketia says, Carlos Ahenkorah’s resignation is not punitive enough for the harm allegedly caused.

Pressure group, Occupy Ghana has recently pressed on government to prosecute the Tema West Constituency legislator for breaching COVID-19 protocols.
