We’ll file an application for review of yesterday’s ruling – Amaliba hints

Director of Legal Affairs of the National Democratic Congress (NDC), Abraham Amaliba, has hinted the lawyers of the petitioner in the election petition before the Supreme Court, John Dramani Mahama, will seek a review of the court’s unanimous decision to dismiss a motion to reopen his case.

Mr Mahama sought to reopen his case to enable his lawyer’s subpoena the Chairperson of the Electoral Commission (EC), Jean Mensa, to appear before the court and testify as a “hostile witness”.

But the panel, in its ruling delivered by Chief Justice Kwasi Anin-Yeboah said “we accordingly refuse the application and proceed without any hesitation to dismiss it”.

But reacting to this in an interview on A1 Radio on Wednesday, Lawyer Amaliba said “We will file an application for review of yesterday’s decision.”

According to him, the legal team of the petitioner will explore all legally allowed avenues to pursue its case.

In an earlier reaction to the Supreme Court’s decision to dismiss Mr. Mahama’s motion to reopen his case, Member of Parliament (MP) for Bolgatanga East Constituency and a spokesperson for the petitioner in the ongoing case, Dr. Dominic Akuritinga Ayine, expressed dissatisfaction at the courts ruling; saying “In our view the court was wrong- in our view, the reasons of the court were based upon wrong legal premises but . . . we are bound by what it has said.”
