SC’s ruling may bring chaos in Parliament – Amaliba

Director of Legal Affairs of the opposition National Democratic Congress (NDC), Lawyer Abraham Amaliba has revealed that the ruling on the case involving the voting rights and counting of the Deputy Speakers to form a quorum and in decision making could result in chaos in Parliament during its implementation.

According to Mr. Amaliba, the Supreme Court interfered in the business of Parliament by striking out Standing Order 109(3) and declaring it as null and void.

He argued that it was a bad ruling and therefore, the Judiciary had breached the rule of separation of powers and sought to interfere in the affairs of Parliament knowing clearly that, every Arm of Government is supposed to work independently with no interference from any other Organ.

He further argued that, “is it not for nothing that in an earlier case, the J.H Mensah case, the same Supreme Court even though not composed of these Judges, said Parliament is a master of its own rules and so what happens in Parliament is a close book. If you have a Supreme Court today going to strike down that regulation, that for me is an interference in the work of Parliament”.

Responding to comments made by the 2020 Presidential candidate for the National Democratic Congress (NDC), John Dramani on the Supreme Court’s ruling, Mr. Amaliba stressed that, it is clear the opposition Members of Parliament see the ruling as interference to legislative processes.

“Already you can see some chaos that is likely to take place if this ruling is to be implemented in the Floor of the House. Don’t forget the reason why this matter even had to go to Court was because of an earlier chaotic situation and one would have thought that the Supreme Court’s ruling would rather bring some sanity but you saw from how Members of Parliament from the Opposition side were up in arms and were not excited by that ruling” he warned.

He, however, explained that a review on this ruling may be impossible if anyone sought to file for a review on that case because of the unanimous nature of the decision taken.
