A Political Analyst, Dr. Yiadom Boakye, has urged political parties who have concerns on the outcome of this year’s presidential election to head to court now to seek a review of the decision by the Electoral Commission (EC) or remain silent after December 28, 2020.
According to him, the move of the EC to gazette the presidential results declared by its Chairperson and Returning Officer of the 2020 presidential polls, Jean Mensa, paves way for parties interested in contesting the results at the law court to do so.
Speaking on A1 Radio, Dr. Yiadom stated that the disgruntled individuals or groups of persons have up to December 28, 2020 to go to court or lose the right to legally contest the outcome of the election.
“A legal backing has been given to the certified results declared and if you want to challenge it, you can only do so at the Supreme Court. It is after the gazetting that somebody can take it to court. If it has not been gazette, you do not have a legal framework based upon which you take your case to court.”
“Those who want to contest the results have 3 weeks after the elections to do so. From 7th December up to 28th December; so today being 17th, they still have 10 more days to go. So if you want to go to court, you have to work within the next 10 days to present your case either than that, you have to keep quiet thereafter. He explained.
On December 7, 2020, Ghana voted for the 8th time since the country turned to constitutional democracy in 1992.
There were 12 presidential candidates.
72 hours after the elections, the EC announced the results and declared the incumbent Nana Addo Dankwa Akufo-Addo of the New Patriotic Party winner.
But the opposition National Democratic Congress (NDC) and its presidential candidate, John Dramani Mahama, have rejected the results claiming the commission rigged the results to favour the NPP.
Mr. Mahama has therefore indicated his party will employ all legitimate means to challenge the outcome of the elections.
Executives of the party are yet to clearly come out with their decision on the way forward.
